Requirements and conditions
If you are still not clear about the requirements and conditions you must have in mind to join the CCB Affiliates Circle, here we show you in detail all the necessary information to access our network of affiliates without any inconvenience; you will also find the CCB affiliates' rules and regulations.
Requirements
To have at least two (2) consecutive years of registration in any chamber of commerce.
To have exercised the mercantile activity during this period.
Pursuant to Article 13 of the Commercial Code, the exercise of commerce is presumed by registration in the Commercial Registry (Matrícula Mercantil).
To have complied on a permanent basis with its obligations derived from being a merchant, including the timely renewal of the Mercantile Registration in each period.
Article 33. Renewal of the Commercial Registration - Term to apply for it. The registration shall be renewed annually, within the first three months of each year. The registered person shall inform the corresponding chamber of commerce of the loss of his status as a merchant, as well as of any change of domicile and other changes relating to his commercial activity, so that a note of the same may be made in the corresponding registry. The same shall be done with respect to branches, commercial establishments and other acts and documents subject to registration.
Pursuant to Article 19 of the Commercial Code, in addition to registering in the Commercial Registry, merchants must comply with the following obligations:
Register in the Commercial Registry all acts, books and documents in respect of which the law requires such formality, as follows:
Natural persons are not required to register trade books in the Commercial Registry; legal entities are only required to register the Register of Partners or Shareholders, the Minute Books of Assemblies and Minutes of the Meeting of Partners. Sole proprietorships, as referred to in Law 222 of 1995, must register the minutes book. The registration of the books is required to be at least 2 years old.
Keep regular accounts of its business in accordance with legal requirements.
Keep, in accordance with the law, the correspondence and other documents related to its business or activities.
To denounce before the competent judge the cessation in the current payment of its commercial obligations.
Refrain from performing acts of unfair competition, understood as any act or fact that is performed in the market for competitive purposes, when it is contrary to sound commercial customs, to the principle of good commercial faith, to honest uses in industrial or commercial matters, or when it is aimed at affecting or affecting the free decision of the buyer or consumer, or the competitive operation of the market (Paragraph 2 of article 10 bis of the Paris Convention, approved by Law 178 of 1994 and retaken in article 7. ° of Law 256 of 1996, art. 7).
Paragraph: these same duties must be permanently fulfilled by the Affiliates in order for them to maintain their status as such.
Joining the CCB is a safe and easy process.


Conditions
Having been sanctioned in disciplinary liability proceedings with dismissal or disqualification from the exercise of public functions.
Having been criminally convicted for fraudulent offenses.
Have been convicted in fiscal liability proceedings.
To have been excluded or suspended from the professional practice of commerce or professional activity.
Be included in inhibitory lists for money laundering or financing of terrorism and any illicit activity.
Paragraph 1. The legal representative of the legal entities must comply with the same requirements and conditions provided for Affiliates, except for the requirement of being a merchant. |
Paragraph 2. In order to maintain the Affiliate status, the merchant must continue to comply with the above requirements and conditions. |
Paragraph 3. The Bogotá Chamber of Commerce will refrain from affiliating or will cancel the affiliation, when it knows that the natural or legal person does not comply or has failed to comply with any of the requirements and conditions established in the current regulations on the matter. |
Paragraph 4. In the event that the legal representative of the Affiliate does not comply or fails to comply with the requirements and conditions, he/she shall be required by the Bogota Chamber of Commerce to correct the cause within a term not to exceed two (2) months, under penalty of disaffiliation. |
