La Costumbre Mercantil es el conjunto de prácticas realizadas por comerciantes de un sector de manera uniforme, reiterada y pública, que al ser certificada facilita su reconocimiento como fuente de derecho comercial. 

• In Bogotá, D. C. and in the municipalities where the Bogotá Chamber of Commerce has jurisdiction, there is a commercial custom that, in audiovisual co-production agreements, the majority co-producer is delegated the decision making on the production of the work, in matters of: (i) administrative matters related to the hiring of personnel; and (ii) logistics during the shooting of the audiovisual production, without implying the transfer of copyrights.

• In Bogotá, D. C. and in the municipalities where the Bogotá Chamber of Commerce exercises jurisdiction, there is a commercial custom that, in the leasing contracts of fire engines, the price is determined based on a minimum of cubic meters of concrete, regardless of the amount actually pumped being lower, in order to guarantee a minimum operational profitability of the equipment, considering the direct and indirect costs of the operation.

• “In Bogotá D.C., it is a commercial custom that in the purchase and sale of goods in food storage and distribution centers, the execution of the contract and payment of the price is evidenced by means of a voucher which, in addition, enables the bearer to claim the goods in the warehouse of the distributor-seller”.

Sector transporte:

• Descuentos en tiquetes aéreos

• Órdenes de contrato en los contratos de transporte

Sector comercio:

• La hora de corte del día en los hoteles en Bogotá (check out)

• Valor del IVA incluido dentro del precio cotizado

Sector automotor:

• Pago de los gastos de traspaso en la compraventa de vehículos particulares usados

Sector editorial:

• Plazo para vender o devolver los libros

• Tienen la misma autoridad de la ley comercial según el artículo 3 del Código de Comercio.

• Cuando certificas tus prácticas como costumbres mercantiles, previenes conflictos, disminuyes costos de transacción y permites la interpretación de contratos.

• En ausencia de ley comercial o estipulación de las partes, la costumbre mercantil será la norma que regule la relación comercial.

• La certificación se constituye en prueba de la costumbre agilizando la construcción probatoria en un eventual proceso legal.
