La Costumbre Mercantil es el conjunto de prácticas realizadas por comerciantes de un sector de manera uniforme, reiterada y pública, que al ser certificada facilita su reconocimiento como fuente de derecho comercial.

• The parking lots outside the public space and that are open to the public in Bogotá allow a time of 15 minutes to leave with the vehicle, after paying the applicable fee. Custom does not exonerate merchants from complying with the duty of clear, complete and timely information regarding the vehicle deposit contract.

• In co-production contracts for audiovisual works, the majority co-producer is delegated decision-making on the production of the work, in matters: (i) administrative related to the hiring of personnel; and (ii) logistical during the filming of the audiovisual production, without implying the transfer of copyright.

• In the leasing contracts of pumpers, the price is determined based on a minimum of cubic meters of concrete, regardless of whether the quantity actually pumped is lower, in order to guarantee a minimum operational profitability of the equipment, considering the direct and indirect costs of the production. operation.

• In the sale and purchase of merchandise in food collection and distribution centers, the conclusion of the contract and payment of the price through the voucher is proven, which additionally enables the bearer to claim the merchandise in the distributor-seller's warehouse.

• Cuando certificas tus prácticas como costumbres mercantiles, previenes conflictos, disminuyes costos de transacción y permites la interpretación de contratos.

• En ausencia de ley comercial o estipulación de las partes, la costumbre mercantil será la norma que regule la relación comercial.

• La certificación se constituye en prueba de la costumbre agilizando la construcción probatoria en un eventual proceso legal.
