Solidary Economy

In accordance with Article 143 of Decree 2150 of 1995, cooperative entities, employee funds and mutual associations, as well as their integration organizations and auxiliary institutions of cooperativism are Non-Profit Entities and shall be constituted by public deed or private document.

This document must be subscribed by all the founding associates and contain a request for the approval of the bylaws.

What is a cooperative?

A non-profit associative enterprise in which the workers or users are simultaneously the contributors and managers of the enterprise. It is created for the purpose of jointly and efficiently producing or distributing goods or services to satisfy the needs of its members and the community in general.

Special requirements for the incorporation of cooperatives

• Minimum of 20 members.

• Proof of the legal representative's compliance with the special rules of cooperativism.

• The incorporation document must be signed by all the grantors or incorporators.

• Its validity is indefinite (External Circular No. 8 of 2012 of the Superintendence of Solidarity Economy).

• Certificate of accreditation on solidarity education, issued by the Special Administrative Unit of Solidarity Organizations (External Circular No. 8 of 2012 of the Superintendence of Solidarity Economy, Decree 019 of 2012).

•  Incorporation of the Non-Profit Organizations referred to in Law 454 of 1998, as well as their reforms, dissolution, liquidation, and rulings related to these acts.

• Appointment, removal or revocation of the administrators or tax auditors, as well as the rulings related to these acts.

• Registration of the special certificate issued by the Superintendence of the Solidarity Economy in the event of having registration in this Superintendence.

• Acts that require registration according to the law.
