Bogotá, May 5, 2026. The Superintendency of Companies with resolution 300-020539 of May 4, 2026 CONFIRMED resolution number 303-014317 of December 24, 2025, through which the administrative action was ARCHIVED initiated by Resolution 303-000076 of April 10, 2025, for alleged irregularities presented by complaint dated February 5, 2025, filed by Mrs. Tania Marcela Malely Hernández Guzmán, Former Vice President Legal Affairs of the Chamber of Commerce of Bogotá, before the Superintendence of Companies, against the members of the Board of Directors: i) Dr. Enrique Vargas Lleras, in his capacity as President of the Board of Directors; i) Alejandro Mejía, in his capacity as Former President of the Board of Directors, until January 16, 2025; and iii) Constanza del Pilar Puentes Trujillo, in its capacity as Secretary of the Board of Directors, due to alleged pressure on decisions related to actions of an official of the Entity, in relation to issues of behavioral patterns of workplace and gender harassment.
Previously, the Superintendence of Companies through resolution 303-016555 of December 20 March 2026, had resolved NOT TO REPLACE Resolution 303-014317 of March 24 December 2025 and, consequently, CONFIRM the contested administrative act, before the appeal for reconsideration and in subsidy of appeal filed on 9 January 2026 by Mrs. Tania Marcela Malely Hernández Guzmán.
Additionally, With resolution 300-020539 of May 4, 2026, the Superintendence of Companies WARNS that there is no appeal against this decision, therefore in accordance with the provisions of the Code of Administrative Procedure and Administrative Litigation.
All the previous decisions, taken legally and impartially by the Superintendency of Companies, demonstrate the ethical and moral behavior of the members of the Board of Directors of the Bogotá Chamber of Commerce who adheres to the principles of integrity, honesty and justice, with respect to the human dignity and in search of the common good, since in accordance with the aforementioned resolutions issued by the Superintendency of Companies, in response to successive requests formulated by Mrs. Tania Marcela Malely Hernández Guzmán, as stated states the most recent resolution at the end of its motivating part, they “do not are called to prosper, as factual budgets are not configured and legal aspects that would justify the taking of new evidence, the declaration of nullity or the adoption of corrective or sanctioning measures.”
