The Arbitration and Conciliation Center of the Bogotá Chamber of Commerce launched a new specialty in its national arbitration services, oriented to the exclusive attention and resolution of legal disputes arising from contractual transactions between partners and companies. This is the corporate arbitration specialty.
The Center constantly conducts studies and research to characterize the most frequent legal needs. In corporate matters, the findings reveal that some of the reasons that usually give rise to disputes of this nature are related to disagreements between partners over the management of the company, the sale or sale of the company's shares or discrepancies over decisions taken at shareholders' meetings.
Conflicts were also identified arising from alliances between companies to execute projects through figures such as joint ventures or consortiums, situations that usually give rise to disputes regarding the assumption of responsibilities of the companies. Understanding the legal conflict - its origins, recurrences and decisional trends - has allowed the CCB's Arbitration and Conciliation Center to optimize its portfolio of services and generate list selection processes that guarantee users the most suitable experts in each area.
Thanks to these findings, the Center, with the approval of the Arbitration Court, deployed a strategy to create a list of arbitrators with extensive experience and recognition in this type of conflicts that will allow a much more efficient attention to the controversies of this sector.
A list with these characteristics will have a positive impact on the country's members and businessmen, since they will have the guarantee of finding in the largest Arbitration and Conciliation Center in the country, the best experts for the attention and solution of their controversies.
The sum of efforts aimed at providing agile, specialized and efficient justice services, demonstrates the Center's interest in improving and optimizing the Dispute Resolution Mechanisms, efforts to demonstrate that another form of justice is possible.
