Transmission and transfer of personal data

Nowadays, personal data is a fundamental input for the development of many new businesses. Data has long been referred to as the new oil. For this reason, the level of protection of the information contained in the data has gradually increased in order to guarantee the fundamental right to habeas data.

In the treatment of personal data, businessmen have the need to make a transfer or transmission of data depending on whether they require, the sending of information which in turn is a responsible or if they seek the communication of data to be processed by a data processor.

Considering the importance of this fundamental right, the Bogota Chamber of Commerce provides businessmen/businesswomen with models of contracts for the transmission and transfer of personal data so that businessmen have legal instruments that allow them to comply with current legislation on the subject.

How do I know if the "Stop Scrubbing" Law applies to me?

With the issuance of Law 2300 of 2023, known as the "stop scrubbing" law, it seeks to place limits on contact with customers and consumers of products and services. But it is important to know when it applies to the employer and what are the rights derived from this new regulation for all users. We will now explain:

On the one hand, it applies to those who perform collection activities directly or indirectly, and, on the other hand, it applies to commercial relations between producers and suppliers of private or public goods and services and the commercial consumer against messages, mails and calls made for commercial or advertising purposes.

In any case, it is relevant to bear in mind that, in our understanding, there must be a consumer relationship between the parties, understood as the link established, on the one hand, between the producer or supplier who supplies a good or provides a service and, on the other hand, the consumer who acquires and uses it as the final recipient to satisfy a need located outside the business or professional field.
