Remember that if you have a commercial establishment open to the public and you use music or audiovisual material through radios or televisions, you are exploiting musical and audiovisual works, therefore, you must obtain the authorization of the owners of the works or performers who will be paid a remuneration for such authorization. This is known as royalty payments and you will have to pay for these, since they are private goods that belong to the composers, artists or other owners.
Certificate of payment or non-payment of copyright
The certificate of payment of copytirhgt royalties is the authorization that corresponds solely and exclusively to the establishments that store, execute, reproduce live or by any electronic means (radio, television, USB memory, cellular, among others) in a permanent or occasional way:
Musical works
Artistic musical performances
Phonograms
Music videos
Literary productions or different forms of works
Audiovisual productions
Printed works through the photocopying system
In accordance with the provisions of Article 87 of the National Police Code regarding the requirements to carry out economic activities:
Article 87. It is mandatory, for the exercise of any activity: commercial, industrial, service, social, cultural, recreational, entertainment, amusement; profit or non-profit, or which, being private, transcend to the public; whether or not it is developed through establishments open or closed to the public, in addition to the requirements provided in special rules, to comply prior to the initiation of the economic activity with the following requirements:
"5. For those establishments where musical works are performed publicly and are subject to payment, protected by the legal provisions in force on copyrights, to keep and present the proof of payment up to date".
